Personal Data (Privacy) Ordinance Policy (PDPO)

Matrix Securities Limited has established and is committed to complying with the Personal Data Privacy Protection Code to comply with the Personal Data (Privacy) Ordinance policy ("PDPO"). This statement explains the reasons for collecting personal data and the purposes for which they are used.

 

1. The Client shall from time to time provide Matrix Securities Limited with relevant information relating to the opening or maintenance of trading accounts, opening or maintaining credit facilities or relating brokerage, stock custody and investment advisory services. The information will be collected by Matrix Securities Limited in accordance with the requirements of relevant laws, regulations, codes and norms.

 

2. Failure to provide such information may result in Matrix Securities Limited being unable to open or maintain an account, or open or maintain a credit facility, or provide securities trading, stock custody and investment advisory services for you.

 

3. Information will also be collected from you as necessary to maintain normal business contacts.

 

4. The main purposes for which your information relates are as follows:

(a) providing you with the relevant day-to-day operation services and credit facilities;

(b) conducting credit checks;

(c) assisting other financial institutions in conducting credit checks;

(d) ensuring that you have a reliable ability to repay your credit;

(e) designing the relevant financial or related products according to your needs;

(f) marketing services, products and other items for you; (See paragraph 6 for details)

(g) ascertaining amounts outstanding or owed to you by you;

(h) collecting from you outstanding and secured monies;

(i) obligations, requirements or arrangements for the disclosure and use of information in order to comply with the requirements of the relevant laws, regulations, rules and norms binding on Matrix Securities Limited;

(j) complying with the relevant requirements of Matrix Securities Limited for the purpose of sanctioning or preventing or detecting money laundering, terrorist financing or other illegal activities;

(k) other purposes that are ancillary or incidental to any of the foregoing.

 

5. Matrix Securities Limited will keep your information confidential but may also disclose your information to the following parties for the purposes set out in paragraph 4:

(a) any member of Matrix Securities Limited, Including the holding company of Matrix Securities

(b) any agent, contractor or third party in connection with management, telecommunications, computer, legal, accounting, stock settlement or other services provided to Matrix Securities Limited;

(c) any person under a duty of confidentiality to Matrix Securities Limited;

(e) financial institutions with which you have or are about to do business;

(f) any actual or potential transferee of Matrix Securities Limited or a participant or sub-participant or assignor of an interest in you owned by Matrix Securities Limited;

(g) relevant persons to whom Matrix Securities Limited is required to make disclosure by law or relevant regulatory authority;

(h) any person with your direct or indirect consent.

 

6. Use of Information in Direct Marketing

Matrix Securities Limited may use your data for direct marketing or marketing activities. Matrix Securities Limited is required to obtain your consent (including an indication of no objection by you) for this purpose.

(a) if you do not want Matrix Securities Limited to use or provide its data to other persons for direct marketing purposes as described above, you may at any time exercise your right to object to direct marketing and request Matrix Securities Limited to stop using your personal data in direct marketing at the address set out in paragraph 10 without charge for this arrangement;

(b) you understand that Matrix Securities Limited must cease using such data for such purposes if you request to stop using such data for direct marketing purposes. At the same time, in order to comply with relevant laws, regulations, codes or guidelines, Matrix Securities Limited will retain such information although it has ceased to use it for direct marketing purposes.

 

7. Subject to the terms of the PDPO, you:

(a) the right to enquire whether Matrix Securities Limited holds his/her data and the right to obtain such data;

(b) the right to request Matrix Securities Limited to correct his/her erroneous or omission information;

(c) the right to enquire about the policies and scope of application of such data held by Matrix Securities Limited and/or any member of the Matrix Asset Management Group and to know the types of personal data held by Matrix Securities Limited and/or any member of the Matrix Asset Management Group.

 

8. Subject to the terms of the PDPO, Matrix Securities Limited has the right to charge a reasonable fee to the person making the data enquiry.

 

9. Nothing in this Statement limits your rights under the Personal Data (Privacy) Ordinance.
